The Energy Tax Incentives Act of 2005 reinstated the Oil Spill Liability Trust Fund tax effective April 1, 2006.  In general, the 5-cent-per-barrel tax ($0.0012 cents per gallon) will be levied on domestic crude oil received at United States refineries and petroleum products imported into the United States for consumption, use or warehousing.

The "Oil Spill Tax" funds are used to defray costs of oil spills and other petroleum-related environmental clean-ups.  This tax is paid by refiners and importers and can be passed on to the consumers of such products.

Some refiners are billing the tax as a "separate line item" and not including the fee in their posted price, while other refiners have chosen to include the fee as part of the posted price.

The line item fee is $0.0012 cents for clear gasoline and diesel fuel. The rate will vary slightly for products blended with ethanol and bio-diesel depending on the blending percentage.

DTN is working to provide the OSLTF information to our FastRacks customers in a format that is acceptable to the user.  We will offer our price reports in three ways: 

• no modification to the prices at all
• prices with the OSLTF added to the suppliers that bill as a separate line item
• prices with the OSLTF removed from the suppliers that include the fee in their posting

We will provide a list of how different suppliers will be reflecting the tax. We strive to make this information as accurate as possible however refiners reserve the right to change their status at any time.
